RESERVATION TERMS & CONDITIONS

ALL USERS OF THE CREEKSIDE PARKING BOOKING SYSTEM ARE REQUESTED TO READ THESE RESERVATION TERMS AND CONDITIONS CAREFULLY.

THE WEBSITE PROVIDERS EXPRESSLY DO NOT PROVIDE A RIGHT OF ENTRY TO THE CREEKSIDE CAR PARK TO ANY USER, OR ANY RIGHT OR PERMISSION TO USE THE CAR PARK. ALL USERS MUST POSSESS THEIR OWN MEANS OF ACCESS TO THE CAR PARK, AND HAVE A RIGHT TO USE IT UNDER THEIR LEASE OR TENANCY AGREEMENT BEFORE MAKING A RESERVATION

USE OF THE CREEKSIDE CAR PARK IS SUBJECT TO THE PREVAILING TERMS AND CONDITIONS SET OUT IN THE LEASES FOR THE PARKING SPACES, AND AS POSTED IN THE CAR PARK.

1. OUR LIABILITY

1.1. The Creekside Parking Website is made available exclusively to private and commercial leaseholders at Creekside Village West, and residents or businesses holding a tenancy agreement a private or commercial leaseholder (the “User”).

The Website providers do not provide a car parking facility or service. The sole service provided is a facility for the User to reserve a parking space owned by another leaseholder for exclusive use for a defined period of time.

By accepting a reservation, the Website providers expressly do not confer a right of entry to the Creekside Car Park to any User. It is the User’s sole responsibility to provide their own access using a security device acquired from the estate managers using their rights as tenants or leaseholders, and to use the car park according to the rights conferred on them in their lease or tenancy agreement.

All use of the car park is subject to the existing rights and limitations set out in the terms of the tenancy agreements and/or the respective leases held by the registered user, and by using the website to reserve a space, the user agrees that they shall not hold the website providers, servants and agents liable for any loss or theft or damage to your vehicle and/or liability for death or personal injury other than where the same is proved and to the extent that is proved to be directly caused by their negligence, wilful act or default or breach of statutory duty.

The maximum liability of the website provider, their servants and agents for any breach of this agreement, or for any loss, theft or damage shall be limited to the amount paid for the parking space reservation.

2. COMPLAINTS

2.1. In the event of any complaint regarding the reservation service provided by the Website, Users are directed to use the email address set out on the Website for communication.

In the event of any damage whilst in the Creekside Car Park or should you lose the vehicle or any of your possessions from the vehicle whilst it is in the Creekside Car Park, you are requested to:

2.1.1. immediately to inform a member of the building’s concierge staff of the occurrence;

2.1.2. in the case of theft, report it to the Police and make a note of the reference number;

2.1.3. notify your insurers promptly.

2.2. If you consider that you have a claim against the Website provider within Condition 1, we request that you promptly after the discovery of the loss or damage, give written notice containing full details of the occurrence to us the email address given on the Website.

2.3. Before submitting a complaint to the Website provider, you are requested to check Condition 1 and to satisfy yourself that the subject matter of your claim falls within our area of responsibility.

3. SECURING YOUR VEHICLE

Users acknowledge that the Website provider does not provide the car park facility or management, permission to use it or any access to it. Users also acknowledge that the car park is not claimed by its management to be 100% secure and damage to vehicles and thefts have occurred in the past.

3.1. It is the responsibility of the User to ensure that their vehicle is properly secured whilst in the Creekside Car Park, including that:

3.1.1. the vehicle is securely locked;

3.1.2. all the windows of the vehicle are securely closed;

3.1.3. if the vehicle is fitted with a steering lock or similar security device, that it is engaged.

4. POSSESSIONS

4.1. Wherever possible, you agree to take your possessions with you when you leave your vehicle. If you have to leave your possessions in your vehicle make sure they are out of sight. You are reminded that your motor insurance policy may not cover possessions in vehicles. It may be possible for you to arrange separate insurance cover for possessions, and we recommend that you do so.

5. COURTESY TO OTHER CAR PARK USERS

Users are reminded that CCTV operates in the Creekside Car Park and will be used wherever possible in the event of any damage to any vehicle.

5.1. Should you damage another vehicle you are requested to report the matter immediately to a member of the building’s concierge staff and give them the registration number of your vehicle and the damaged vehicle.

6. SAFETY IN THE CAR PARK

6.1. Car parks are to be used only for lawful purposes and in accordance with the terms of the lease and the prevailing parking conditions of the management company.

6.2. Car parks can be dangerous:

6.2.1. please drive carefully in the Creekside Car Park and obey the directional signs and speed limit;

6.2.2. after you have parked your vehicle please proceed to the nearest exit. All exits are signposted;

6.2.3. do not wander about the Creekside Car Park;

6.2.4. keep a careful eye on people in your care;

6.2.5. do not permit children to play in the Creekside Car Park.

7. Reservation Emails

7.1. The reservation email issued to you is for use only for the vehicle in respect of which it is issued. A reservation can only be used by you (unless otherwise specified by us) for the specific space in the Car Park for which it was issued.

7.2. The reservation email must be displayed on the dashboard of the vehicle while it is using the space denoted upon it.

7.3. Any vehicle parked in outside the time period specified in the reservation email, or otherwise than in the space denoted upon it, will be considered to be in breach of the Creekside Car Park parking conditions and will be subject to the prevailing penalties at the time applied by the Creekside management company.

9. PARKING RESTRICTIONS

9.1. The User acknowledges that reservations provided from the Creekside Parking Website do not confer rights of access to, or use of, the Creekside Car Park. Consequently the Website provider shall not be responsible for any inability to access the car park, or any restrictions put in place by the management company preventing the User from using the car park.

11 RESERVATION FEES

11.1 The applicable tariffs are be displayed on the reservation Website.

12 PROHIBITED ACTIVITIES

12.1 All use of the Creekside Car Park is subject to the conditions of the User’s tenancy or lease, and the Car Park Terms & Conditions, displayed in the Car Park.
